Terms of Service
Effective September 10, 2026
The service.
Spot & Rally publishes a paid Sponsor Board and a separate Amplifier Board based on Verified Attention. These Terms form an agreement between you and the California-based operator of Spot & Rally. The commercial contracting identity and role-based contact details will be stated before live payments are enabled; until then, payment functionality is limited to clearly labeled tests. The service does not publish the operator's residential address.
The service is evolving. We may change, suspend, or discontinue a feature, preserve data required for safety or law, and correct ranking or scoring errors. We do not promise continuous availability, a particular rank, traffic, sales, or reputation.
Adults in the United States.
Public pages can be read without an account. To create or change public data, report content, start a rally, administer a Sponsor, or use payment features, you must be at least 18, located in the United States, able to form this agreement, and provide accurate account information. Organization users represent that they have authority to act for the organization.
Keep your account secure and notify support@spotandrally.comof suspected unauthorized use. You are responsible for activity performed through your account unless law provides otherwise.
Your content and permissions.
You keep ownership of content you submit. You grant Spot & Rally a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, distribute, and moderate that content only as reasonably needed to operate, secure, explain, and promote your participation in the service. The license ends when the content is deleted, except for cached copies, public shares, backups, legal records, and content retained under a valid exception.
You represent that you have the necessary rights, that your submissions are accurate and lawful, and that they comply with the Acceptable Use Policy and Participant Rules. Product ownership claims may require evidence and operator review.
Two independent rankings.
Sponsor rank is paid placement calculated from settled Sponsor payments, net of recorded refunds, reversals, disputes, and adjustments. Verified Attention is a separate reputation signal governed by the Participant Rules. Payment never buys Verified Attention, favorable moderation, an endorsement, or a guaranteed outcome. Amplifiers receive no compensation from Spot & Rally.
Moderation and termination.
We may reject, limit, suspend, remove, merge, correct, or preserve content, accounts, scores, and claims to enforce policy, protect people or systems, investigate fraud, comply with law, or correct errors. When practical, we provide a reason and an appeal path. You may stop using the service and request account deletion under the Privacy Notice.
Disclaimers and limits.
To the fullest extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness, noninfringement, accuracy, or a particular result. Third-party products and links are controlled by others and are not endorsed or warranted by Spot & Rally.
To the fullest extent permitted by law, Spot & Rally is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, goodwill, or opportunities. Aggregate liability for a claim is limited to the greater of $100 or the amount you paid Spot & Rally during the six months before the event giving rise to the claim. These limits do not exclude liability that cannot lawfully be limited.
If you use the service for an organization, you will defend and indemnify the operator against third-party claims caused by your unlawful content, material breach, or infringement, except to the extent caused by the operator. Consumer rights that cannot be waived remain intact.
California law and courts.
California law governs without regard to conflict-of-law rules, subject to non-waivable protections where you live. Disputes must be brought in the state or federal courts serving Santa Clara County, California, and each party consents to those courts. Small claims actions remain available. These Terms do not require arbitration and do not waive class procedures.
Changes and contact.
Material changes receive a new effective date and, when they affect participants, renewed acceptance before the next account action. If a provision is unenforceable, the remainder continues. Failure to enforce once is not a waiver. Contact legal@spotandrally.com.
